Terms and Conditions of Service and Acceptable Use Policy
The following statement of Terms and Conditions governs both WJ Web Enterprises Inc. (BCwebnet) and its customers. Please read it carefully. All customers of BCwebnet are deemed to have read, understood and agreed to the entire contents of the BCwebnet Terms and Conditions effective the date of signup. If you have any questions or concerns, or require clarification of any of the terms below, please do not hesitate to contact us.
This represents the complete agreement between BCwebnet and the BCwebnet Customer (Customer). BCwebnet and Customer agree that BCwebnet will provide certain Internet access services and that the Customer will pay for those services in accordance with the provisions of this agreement. This agreement supersedes any prior agreements, either written or oral, between BCwebnet and Customer with respect to BCwebnet accounts. BCwebnet may revise or modify this agreement (including terms, conditions, and/or prices) at any time without prior notice, and any such modification will become effective upon posting of any such revisions or modifications to BCwebnet's website or on the date stated in the agreement, if a date is so stated.
Definitions
Customer: an individual or business that establishes an account with BCwebnet
or purchases services such as domain registration.
E-Mail or DNS account: hosting of services related to your domain
name, but do not include hosting of your web site.
Web Hosting: an account whereby Customer is provided with access
to storage space for material that can be viewed on the World Wide Web.
Technical Support: assistance provided by BCwebnet employees
to facilitate Customer access to the BCwebnet network and through it to the
Internet.
Services and Liability
1) Neither BCwebnet nor its providers exercises any control whatsoever over
the content of information passing through its network and/or equipment.
2) BCwebnet makes no warranties of any kind, whether express or implied, for the service it is providing. BCwebnet also disclaims any warranty of merchantability or fitness for any particular purpose. BCwebnet will not be responsible for any loss or damage the customer or customer's equipment may sustain as a result of access to its network. This includes, but is not limited to: loss of data resulting from delays, non deliveries, mis-deliveries, failures of service or by strikes, labour disputes, Forces of Nature or any event of force or service interruptions.
3) BCwebnet may be used only for lawful purposes. Transmission of any material in violation of any international, federal or provincial regulations is strictly prohibited. This includes, but is not limited to: copyrighted material, threatening or obscene material, or material protected by trade secret.
4) BCwebnet may terminate any Customer's account without notice if, in the sole judgment of BCwebnet management, it is determined that the account is being used in a manner contrary to its intended use as defined by this agreement. Upon termination, the balance of any prepaid monies will be refunded within 30 days.
Pricing for Services
1) BCwebnet reserves the right to modify its prices and/or services at any time.
BCwebnet will provide notice of any changes to its customers by posting notice
on the BCwebnet website. It is the responsibility of the Customer to remain
abreast of such notices by browsing the appropriate section of the BCwebnet
website regularly.
2) Price changes will take effect and will be charged to the customer in the billing cycle immediately following the month in which the notice is posted.
3) Accounts must be paid
in advance and may be billed
a) Monthly: BCwebnet must be authorised to automatically debit a bank account
or credit card or be provided with post-dated cheques covering three months
of service.
b) Quarterly: payment is due within 10 days of the date of invoice.
c) Bi-Annually: payment is due within 10 days of the date of invoice.
d) Annually: payment is due within 10 days of the date of invoice.
4) Accounts are in default if payment is not received within 20 days of the date of the invoice. If payment is returned to BCwebnet N.S.F., the customer is immediately in default and subject to an administration fee in the amount of $30.00, in addition to any charges the customer's bank may have levied.
5) Accounts unpaid after
30 days from the date of the invoice may have their service interrupted. Such
interruption does not relieve the customer from paying the outstanding account
charges. Only a written request to terminate service relieves the subscriber
of the obligation to pay the monthly account charge.
a) An act of default accelerates payments to be due immediately, as credit is
no longer being extended. BCwebnet reserves the right to demand advance payment
before setting up any account.
b) Accounts in default are subject to a late payment charge of $30.00 and interest
will be charged at the rate of 25% per annum on any outstanding balance.
Canceling Your Account
1) A Customer must provide BCwebnet with 30 days written (paper or email) notice
of cancellation. BCwebnet cannot accept account cancellations over the telephone.
2) Credit Card and Customers will make a final payment in the billing cycle immediately following BCwebnet's receipt of the cancellation notice, and service will continue until the end of the final month for which they are billed.
3) Customers paying quarterly will not be billed again after receipt by BCwebnet of their cancellation notice, and service will continue until the end of the quarter for which the Customer has already paid. A customer will not be refunded any portion of a quarterly installment, including set up costs.
Misuse of BCwebnet
Network
1) BCwebnet reserves the right to cancel services in the event of violation
of any of these terms and conditions or abuse or misuse of the service.
2) Abuse and/or misuse of the service includes, but is not limited to: illegal activities over the Internet; inappropriate behaviour toward individuals on the system; posting of any material considered inappropriate by BCwebnet, and use of abusive language when conversing with BCwebnet. The determination of these conditions rests exclusively with BCwebnet.
Confidentiality

1) It is the Customer's responsibility to keep passwords confidential.
2) Any information provided by a Customer to BCwebnet is considered confidential and treated accordingly.
3) BCwebnet will disclose any information as necessary to satisfy any law, regulation or other governmental request. BCwebnet will not intentionally monitor or disclose any private electronic-mail message unless required by law. BCwebnet reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of these Terms and Conditions.
General
1) These terms and conditions shall supersede all previous representations,
understandings or agreements and shall prevail notwithstanding of any variance
with terms and conditions of any order submitted.
2) These terms and conditions are governed by the laws of Canada and British Columbia.
3) If the stated Terms and Conditions of Service are in any way unacceptable, Customers are under no obligation to subscribe to the services provided by BCwebnet.
Web Site Standards
The following is BCwebnet's outline for standards that we expect all of our
clients to respect in dealing with information provided via our web hosting
service:
All web pages and or services must conform to broadcast standards currently
enforced under Canadian law, meet or exceed local, provincial or national laws
and respect copyright considerations.
BCwebnet will not allow any material which is considered to be pornographic,
exploitive of race, religion, sex, creed, disability, hairstyle, shoe size,
or any other form of discrimination whether blatant or subtle to be distributed
in or upon its servers.
Furthermore, BCwebnet reserves the right to remove any such material from our
servers at any time.
